Terms of Use
These terms are an agreement between you and Create Business Solutions, LLC, a Virginia limited liability company doing business as Kasvu (“Kasvu,” “we,” “us,” or “our”). Create Business Solutions, LLC is the contracting provider. They cover your use of the app and the account service behind it. Apple's standard Licensed Application End User License Agreement also applies to the copy of the app you download from the App Store. You accept these terms by creating an account, confirming acceptance in the app, purchasing a subscription, or using Kasvu after receiving notice of them.
Scope, milestones and changes
Kasvu is a standardized consumer subscription service with the features described in the app and on its product pages; it is not project work and does not include a statement of work, delivery milestones or customer signoff unless Create Business Solutions, LLC separately signs a written order or statement of work with you. Any such document will state its scope, deliverables, responsibilities, schedule, acceptance criteria and fees. Changes to that project scope require a written change order accepted by both parties before additional work begins.
Not medical advice
Kasvu measures heart rate variability and heart rate and computes a recovery score and training plan from your own logged sessions. It is a training tool, not a medical device, and nothing in it is medical advice, diagnosis or treatment. Heart rate variability is affected by illness, alcohol, sleep, stress, medication and many other things. Do not use the app to make decisions about your health. If you have a heart condition, are pregnant, or have been told to limit exertion, follow your doctor's guidance over anything the app shows. If you feel unwell during exercise, stop.
Training is at your own risk
Lifting weights and endurance training carry a risk of injury. Loads and reps shown in the app are computed by fixed rules from what you have previously lifted; the app never knows your form, your fatigue or your surroundings. You are responsible for choosing what to attempt, using safe equipment and spotters, and stopping when something is wrong. Recovery adjustments only ever reduce a session; a "recovered" score is not a promise you cannot get hurt.
Your account
An account is optional. If you create one you are responsible for keeping access to your Apple ID or email secure. You may delete your account at any time from inside the app; a successful request removes associated live account records. Backups and previously shared copies have separate limits (see the Privacy Policy).
Circle sharing
Joining a Circle lets its members see your shared recovery and workout information, including session details and history. They cannot edit your workouts. Routes are not shared by default; sharing masked or full routes requires your choice. Only join with people you trust. Leaving stops new access through that membership, but cannot erase information members already saw or copied. See the Privacy Policy for route controls and masking limitations.
Connected coaching
You can authorize an assistant you use to access your Kasvu account through the connector. Its provider's account requirements and terms apply separately. The assistant can offer proposals; you decide whether to accept them in Kasvu. A proposal is not a medical assessment or a session you have already completed. A Kasvu purchase does not include a subscription to a third-party AI service or a human trainer.
Third-party services and liability
Apple, HealthKit, AI assistants and other connected services are governed by their own terms. Kasvu does not control their availability or practices and does not assume another person's duties, promises or liability unless an authorized representative of Create Business Solutions, LLC expressly agrees in a signed writing.
Your data
You own your data. We use it only to provide the service to you, as described in the Privacy Policy. You can export locally stored training data in the app and contact us to request account data; see the Privacy Policy for export scope.
Acceptable use
Do not attempt to access other users' data, interfere with the service, or reverse the security measures that protect it. Do not use the app for anything unlawful.
Availability and changes
We aim to keep the service running but do not guarantee it will always be available or error-free. Features may change. Where a change removes something you rely on, we will say so in advance where practical. Your data on the phone continues to work if the account service is unavailable.
Purchases
Kasvu Pro offers monthly and yearly subscriptions through Apple for Circle sharing, the AI connector and program editing. Backup and sync stay free. The yearly subscription is charged upfront for the year. The App Store price and billing period are shown before you confirm a purchase. Subscriptions renew automatically unless cancelled in your Apple ID settings at least 24 hours before the end of the current period. Use Restore purchases in Kasvu to check purchases made with your Apple ID. Deleting Kasvu or your Kasvu account does not cancel your Apple subscription; cancel it separately in your Apple ID subscription settings. Refunds are handled by Apple under their policies.
Warranty disclaimer
TO THE MAXIMUM EXTENT PERMITTED BY LAW, KASVU IS PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED, ERROR-FREE OR COMPLETELY SECURE OPERATION, ACCURATE SENSOR DATA, OR ANY PARTICULAR TRAINING, FITNESS OR HEALTH RESULT.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CREATE BUSINESS SOLUTIONS, LLC WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE OR CONSEQUENTIAL DAMAGES, OR LOST DATA, PROFITS, REVENUE, GOODWILL OR BUSINESS INTERRUPTION. OUR TOTAL LIABILITY ARISING FROM KASVU WILL NOT EXCEED THE AMOUNT YOU PAID FOR KASVU DURING THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. Nothing here limits consumer rights or liability that cannot be limited by contract.
Indemnification and hold harmless
To the extent permitted by law, you will indemnify and hold harmless Create Business Solutions, LLC and its members, employees and contractors from third-party claims and reasonable costs arising from your unlawful use of Kasvu, content you submit or share, or material breach of these terms. This does not apply to our own gross negligence or willful misconduct.
Exclusive remedy
For a substantiated failure of a paid Kasvu feature to operate materially as described, your exclusive remedy is, at our option, correction of the affected feature or a request for a refund through Apple under Apple's applicable refund process. This is subject to applicable law and the liability limits above.
Disputes and binding arbitration
Before filing a claim, each party will give written notice and allow 30 days for informal resolution. Except for small-claims matters or temporary injunctive relief, disputes will be resolved by confidential, individual binding arbitration administered by the American Arbitration Association under its applicable consumer rules, in Virginia or remotely. You and Create Business Solutions, LLC waive jury trial and class or representative proceedings to the extent permitted by law. Virginia law governs these terms.
Termination
You can stop using the app and delete your account at any time. We may suspend an account that breaks these terms.
